A Queens public school teacher turned a 2nd-floor classroom into an after-school sex den, luring her teenage student into a torrid fling, prosecutors said.
Melissa Weber, 27, a social studies teacher at Middle School/Intermediate School 8 in Jamaica, seduced the 14-year-old male student seven times over the past month, prosecutors said.
She allegedly warned the teen not to tell anyone about their affair - warning him, "I could lose my job and my teaching license."
Weber is being held pending arraignment in Queens Criminal Court on charges of second-degree rape, sex abuse and endangering the welfare of a child, prosecutors said.
The pair met between 3 p.m. and 6 p.m. from Apr. 13 - May 14, prosecutors said.
The sessions came to light when the victim's mom, who is on the Parent Teacher Association, was tipped off by someone in the school, prosecutors said.
The resourceful mom got Weber's cellphone number and compared it to her son's phone.
There were hundreds of exchanges between the pair - including a text message from Weber that read, "erase your phone," prosecutors said.
Weber, of West Babylon, L.I., has worked at the school since 2007.

Rihanna Will Testify at Chris Brown Hearing On June 22nd

At a pre-trial hearing in the Chris Brown case today, Rihanna’s lawyer Donald Etra was informed by the Los Angeles District Attorney that his client will be subpoenaed and called to the stand on June 22nd, potentially bringing the “Umbrella” singer face to face with her alleged assailant in court, TMZ reports. Etra added that, as Rock Daily reported, Rihanna will cooperate with the DA’s request and take the stand at the preliminary hearing. Chris Brown was not in court today when the District Attorney announced the plans to call in Rihanna.

Also in court today, the judge rejected a request by Brown’s lawyer Mark Geragos to turn over police records regarding the leaked photos of Rihanna’s “horrific” injuries following her alleged February 8th altercation with Brown. Brown was charged with two felonies, assault and making criminal threats, and pleaded not guilty to both counts. As Rock Daily previously reported, Geragos claimed the leaked photos tarnished Brown’s reputation and possibly prevented the singer from getting a non-biased jury pool for his prospective trial.

Fergie - Barca deserved win


Manchester United boss Sir Alex Ferguson was gracious in defeat as he admitted Barcelona were the better team and deserved to win the UEFA Champions League final.

Samuel Eto'o struck against the run of play after 10 minutes and thereafter Barca were by far the better side.

They sealed victory when Lionel Messi headed home midway through the second-half.

And Ferguson admits Barca deserved to dethrone United.

"I think the first goal was a killer, the first attack they had they scored and that was a bad start to the game for us," Ferguson told Sky Sports.

"We started brightly too, very confident but we got a little nervous after that of course and when they have a goal they can keep the ball all night and we just didn't have enough.
"We has some good half-chances in the second-half, and we perhaps should have done better - but in fairness we were beaten by a better team.
"We weren't at our best, but after the first goal it was hard for us."
Ferguson admitted that his side could not get at Barca as they had hoped.
"I brought on Carlos Tevez, I took the gamble with two through (the middle) - we needed somebody to drop in - they defended quite well and we could have got at their back four better than we did," he continued.
Despite losing, the Scottish tactician insisted his side can still learn a lot from the loss in the Eternal City.

"That is the best part of the game, in adversity you always move forward - we are still a good team and can move forward," he insisted.

Centre-back Rio Ferdinand said that no United player could come away from the Stadio Olimpico with their head held high.
He said: "Not one of us can say we played well tonight. It's a shame we didn't play well, but we still created five or six chances.

Tyson's Daughter Dies After Treadmill Tragedy


Boxer Mike Tyson's four-year-old daughter has died after accidentally strangling herself on a treadmill.
Exodus Tyson was found hanging from a cord dangling from the exercise machine at her home in Phoenix, Arizona.

She was rushed to hospital in an "extremely critical condition" and put on a life support machine, but pronounced dead yesterday at noon local time.

Police said Exodus was playing on the treadmill when her head apparently slipped inside a cord hanging under the console.

In a statement, the Tyson family said: "There are no words to describe the tragic loss of our beloved Exodus.

"We ask you now to please respect our need at this very difficult time for privacy to grieve and try to help each other heal."

Exodus was found with the cord around her neck by her seven-year-old brother.

While emergency services rushed to the scene, the girl's mother tried to revive the child.

He said: "Somehow she was playing on this treadmill, and there's a cord that hangs under the console, it's kind of a loop.

"Either she slipped or put her head in the loop, but it acted like a noose and she was obviously unable to get herself out of it."

The former boxer's spokeswoman, Cynthia Schwartz, said the family has not yet arranged a funeral.

ROME (AFP) - When two of the world's best players face off in Wednesday night's Champions League final, the men charged with stopping Cristiano Ronaldo and Lionel Messi know there is no room for error.

Defending champions Manchester United will walk out at Rome's Olympic Stadium for Wednesday's show-case final to face a Barcelona side who have already humiliated European giants Bayern Munich and Real Madrid this season.

It promises to be a battle royal between two teams at the peak of their powers and includes a sub-battle between arguably the world's best two attacking players who can terrorise defences on their day.

United's Ronaldo currently has the upper hand having won both the world player of the year crown and the Ballon d'Or in 2008 while his side aim to retain their Champions League title by beating Messi's Barcelona side.

Dead-ball specialist Ronaldo hit a staggering 42 goals in all competitions last season, but his winner away to Porto and two at Arsenal in this season's Champions League campaign have gone some way to answering criticism of his big-game temperament.

Barcelona centre-back Yaya Toure admits the Spaniards can ill-afford to allow Ronaldo the freedom to control the midfield if they are to fulfill their ambition to win the competition they last claimed in 2006.

"They are physically very strong, they have a truly great footballer in Cristiano Ronaldo and they won the Champions League last year, so we know it will be very difficult," said the 26-year-old Ivory Coast international.

"It will be a great game and it's important that we play at 100 percent because anything less and you cannot beat this team."

While Ronaldo can strike fear into the heart of any goalkeeper with the deadball, Messi can give defenders nightmares with his ability to beat opponents with the slightest of touches from his favoured left-foot.

United defender Patrice Evra, 28, insists there is no special preparation for facing the Argentinian winger, but feels that coming up against the likes of Ronaldo and Wayne Rooney every day in training is adequate.

And the knowledge he would have to face the wrath of United manager Sir Alex Ferguson in the event of a poor display is an added incentive when dealing with Messi who came second in the voting for the world player of the year.

"Messi is a great player. I might stop him 10 times, but if on the 11th he goes past me and scores, people will say I have played badly against him," said the French international.

Both supporters and opponents of Proposition 8 waste no time in starting to gear up for the continued battle that both sides believe lies ahead. And both sides are equally determined.
The California Supreme Court's ruling on Proposition 8 settled the law, but politically it simply marked the beginning of the next campaign, expected in 2010, in which voters are likely to again be asked to decide the question of gay marriage.

Indeed, less than 90 minutes after the court released its ruling, both sides in the fight had already e-mailed supporters soliciting funds."We don't have time to mourn the failure of the state court to restore marriage equality to California," wrote Rick Jacobs, chairman of the Courage Campaign, in a 10:15 a.m. e-mail. He added that it was "time to go on offense" and asked supporters to send money for pro-gay-marriage advertising that could begin airing on television later this week.

Ron Prentice, chairman of ProtectMarriage.com, waited until a little after 11 a.m. to hit up his supporters, writing, "We must turn our attention to protecting this victory . . . and must raise several million dollars to get our message out. . . . Please click here to make a contribution."

In addition to buying advertising on television, both sides are also hiring community organizers who will help supporters reach out to sway individual voters.

Among those prepared to keep fighting is Bill Welsh, senior pastor of Refuge Calvary Chapel in Huntington Beach. An ardent supporter of Proposition 8, Welsh spent hours on the street with a sign reading "Marriage is one man and one woman" and leading his congregation of 1,500 in gathering signatures to get the measure on the November ballot.

On Tuesday, he said he felt "pleased that they upheld the will of the people, especially in the increasingly lax moral climate that we're in." But he added that it would be "foolish to think this will be the end of the battle.

"I don't have any desire to get in a violent war with anyone over this, but we won't back down," he said.

On the other side, gay rights activists, who had widely expected to lose, indicated after the ruling that next time they intend to be far more inclusive in their quest to sway Californians. During the last election, the No on 8 campaign was sharply criticized for not reaching out enough to black and Latino voters.

Accordingly, gay activists summoned the media to the Lucy Florence Cultural Center in Leimert Park in the heart of Los Angeles' black community for a news conference chaired by Ron Buckmire, an African American mathematics professor who is also president of the Barbara Jordan/Bayard Rustin Coalition, a black gay rights group in Los Angeles.

Then they made sure that Southern California's first post-decision protest rally was held in East Los Angeles, in the region's historic center of Latino culture.

At that event, more than 100 people gathered outside the L.A. County office building on Cesar Chavez Avenue chanting slogans such as "Gay, Straight, Black, White, Marriage is a Civil Right." Three gay couples then occupied the marriage license office, saying they would not leave without a license to wed. County officials refused to give licenses out -- but also refused to take the demonstrators into custody.

About 3:45, the demonstrators gave up and left.

"They wouldn't arrest us!" cried Tony Espinosa, 45, of Hollywood, as he exited.

He headed for another protest in West Hollywood.

In San Francisco, meanwhile, police arrested more than 150 people after pro-gay-marriage demonstrators marched to the intersection of Van Ness Avenue and Grove Street and sat down, blocking one of the city's main arteries. They were cited and released.

"It's about raising awareness and keeping the struggle going," said Aubra Fletcher, 33, of Berkeley, as she sat, smiling and waiting to be arrested.

Other rallies were planned for more than 100 California cities, including Eureka, San Diego and Palm Springs.

Across the state, gay marriage supporters emphasized the same message.

"Tonight, we take to the streets. But tomorrow, we must continue the hard work," said Lorri L. Jean, chief executive of the Los Angeles Gay and Lesbian Center.

Facebook block ahead of Iran vote hampers youth

TEHRAN, Iran – Iran's decision to block access to Facebook — less than three weeks before nationwide elections — drew sharp criticism Sunday from a reformist opposition hoping to mobilize the youth vote and unseat President Mahmoud Ahmadinejad.

The decision, critics said, forces Iranians to rely on state-run media and other government sources ahead of the June 12 election.

It also appeared to be a direct strike at the youth vote that could pose challenges to Ahmadinejad's re-election bid.

More than half of Iran's population was born after the 1979 Islamic Revolution and young voters make up a huge bloc — which helped former reformist President Mohammad Khatami to back-to-back victories in 1997 and 2001 but failed to rally strongly behind Ahmadinejad's opponent, Akbar Hashemi Rafsanjani, four years ago.

Young voters are now strongly courted by the main reformist candidate, Mir Hossein Mousavi, as the possible swing factor.

"Every single media outlet that is seen as competition for Ahmadinejad is at risk of being closed," said Shahab Tabatabaei, a top aide for Mousavi, the leading reformist candidate. "Placing limits on the competition is the top priority of the government."

Tabatabaei said the Facebook block was "a swift reaction" to a major pro-Mousavi rally Saturday in a Tehran sports stadium that included an appearance by Khatami and many young people waving green banners and scarves — the symbolic color of the Mousavi campaign.

Iranian authorities often block specific Web sites and blogs considered critical of the Islamic regime, but critics of the latest decision said the loss of Facebook — and possibly other Web sites popular with reformists — means Iranians must rely on the government for information.

"Facebook is one of the only independent sources that the Iranian youth could use to communicate," said Mohammed Ali Abtahi, a former vice president and now adviser to another pro-reform candidate, Mahdi Karroubi, a former parliament speaker.

During the last presidential race in 2005, information about rallies and campaign updates were sent by text message. In recent years, political blogs by Iranians in the country and abroad have grown sharply. Newcomers such as Twitter also are gaining in popularity.

Iranian officials did not comment on the reported block, but Facebook criticized the decision.

"We are disappointed to learn of reports that users in Iran may not have access to Facebook, especially at a time when voters are turning to the Internet as a source of information about election candidates and their positions," Elizabeth Linder, a spokeswoman for Facebook, said in an e-mailed statement following questions from The Associated Press.

"It is always a shame when a country's cultural and political concerns lead to limits being placed on the opportunity for sharing and expression that the Internet provides," she wrote.

Linder said the company generally does not give out details on the number of users in a given country, and could not say how many members Facebook has in Iran.

But Jay-Z still owes Def Jam one more album. Now, that limitation has been lifted, thanks to a seemingly-cordial negotiation between the rapper and UMG chief Doug Morris. "I thank [Doug Morris] for allowing me to be a completely independent artist," Jay-Z told RapRadar.com. Earlier, Hits Magazine sparked the speculation by pointing to a $5 million buyout price, complete with a friendly handshake.

Now, the rapper is getting started on his new sub-company, Roc Nation. The initiative includes a stable of talented music executives, artists, and partnerships, though Universal Music Group could participate in future distribution.

The Toon are doon. And no amount of weeping chubby Geordies or stony-faced stoicism from Alan Shearer can deflect from the fact that in their final, crucial hour yesterday Newcastle United were utterly, inexcusably, hopeless.

It was as if all the ineptitude of the Mike Ashley regime, all the terrible decisions, all the awful signings combined to produced one last supremely rubbish performance. You might have thought Newcastle would at least go down fighting, perhaps summoning some hitherto unknown reserve to get the single goal that would have preserved their Premier League status. But instead they were as bad as we always feared they were.

With his tie loosened, Shearer desperately tried to suppress an expression of rising panic. But then from his players even panic would have been an improvement. Instead, Newcastle played for their Premier League status with all the enthusiasm of a teenager forced to re-sit an exam on a sunny day. David Edgar was dismissed for his second yellow card in the dying seconds and could not get down the tunnel quick enough.

The winning goal was suitably pathetic, a Gareth Barry shot deflected in off Damien Duff, and for most of the game Aston Villa looked in a different league to Newcastle, which of course they now are. The Championship awaits and next season when those Geordies "gan doon" the Scotswood Road, or any other road for that matter, it will be the likes of Peterborough United and Scunthorpe who will be waiting for them.

Afterwards, Shearer heaped the blame upon himself, his managerial predecessors, his players, even the owner Ashley. He talked about his fear that, figuratively speaking, for every day the club procrastinated in making changes "another room burned". That is Newcastle United for you, a shabby old stately home slowly being engulfed by flames while the befuddled aristocrat in charge pours another drink.

As has been the case throughout most of his reign, apart from his one victory over Middlesbrough, Shearer looked out of his depth and, given the player he once was, strangely lacking in assurance. At the final whistle he made as if to go towards the Newcastle fans and then hesitated in the middle of the pitch. In the end it was an undignified bolt for the tunnel from the men in black and white.

As 16 years of Premier League status was brought to a pathetic end at a club that finished third just six years ago, so you could tick off the ruined careers of those who had been part of the decline. Michael Owen, Nicky Butt, Mark Viduka, Duff and Alan Smith – who did not even make it off the bench – were all once bonafide Premier League stars, although never during their time at Newcastle. And all of them must shoulder part of the blame.

It is Owen's career which has been incinerated in the most spectacular fashion by his contact with Newcastle, four years to transform him from one of the best strikers in Europe into a free transfer who will be lucky to get a top-10 club this summer. He came on yesterday with 24 minutes remaining and did not manage a shot on goal. The way in which he was brushed off the ball by Curtis Davies in one challenge demonstrated bluntly Owen's new-found mediocrity.

The truth is that Aston Villa, finishing a very creditable sixth in the Premier League, did not play well. They did not have to. Apart from a brief flurry at the start of the game during which Peter Lovenkrands' effort was kicked off the line by Carlos Cuellar and Obafemi Martins volleyed a shot over there was nothing of any note in their attack. Martins headed wide before half-time and that was it.

"Whose your new Messiah: Ant or Dec?" asked a banner on the Holte End at the start of the match. "Sob on the Tyne" was the one they unfurled at full-time. The Newcastle fans had already beaten them to it, blubbering away in front of the cameras long before then. The aftermath of relegation is likely to be even more mind-boggling with at least 15 first-team players thought to be on £50,000-a-week or more contracts with no provision for a cut in the event of relegation.

The only good news for Newcastle fans is at least Owen did not sign what would have been a financially-crippling second contract for the club when he was offered it last year. Newcastle will get more than £30m in Premier League prize money for this season but if the "overhaul" that Shearer demanded does not take place then there will be no guarantee of them coming straight back up.

Fabricio Coloccini was predictably desperate in defence and the first warning to Newcastle was a shot smashed in by Craig Gardner that Steve Harper did well to tip over. In fact it was a much better attempt than the shot from which Villa eventually scored in the 38th minute, a tame hit by Barry that took an outrageous deflection off Duff and past Harper.

It was pitiful end for Newcastle, the ebbing of a Premier League existence without any real conviction. Butt presented Barry with the ball on 70 minutes and he could only put his shot wide. Later Gabriel Agbonlahor put a cross at John Carew's feet just a few yards out and he contrived to miss. Did Villa feel sorry for them?

If they did feel sympathy then it was undeserved. Save that for the supporters of the club who no-one would blame if they decided to be more selective about their attendance next season. For a moment, put aside the pity for a big club in a region of England that had had more than its fair share of bad luck. This was just a bad Newcastle team which, with 34 points, deserved to go down.

President Obama ready to make his choice for Supreme Court

President Obama says his first nomination of a new Supreme Court justice is imminent - and he feels no pressure to appoint a woman to the prized post.

"I don't feel weighed down by having to choose a Supreme Court justice based on demographics. I certainly think that ultimately we want a Supreme Court that is reflective of the incredible variety of the American people," Obama said in a 30-minute C-SPAN interview that aired Saturday.

Obama, who could announce his pick to replace departing Justice David Souter as early as this week, says he hopes to have confirmation hearings in July.

What he doesn't want to see is someone having to "hit the ground running and then take their seat in October without having the time to wrap their mind around the fact that they are going to be a Supreme Court justice," he said.

The President, a former law professor, says he will seek a new justice who possesses both intellect and a common-sense approach to the law's application.

Asked if he'd have an interest in serving on the court himself after the presidency - as William Howard Taft did - Obama joked, "I am not sure that I could get through Senate confirmation."

Imo,if Obama really wants to restore respect and deference to the precepts of the Constitution that he swore to defend, he should choose a proponent of taking the ideas and ideals of the Constitution literally, as people such as Andrew Napolitano would. He has all of the qualifications that our President mentioned in his CNBC interview and I believe he would make a good Justice because he has been politically free from partisan politics since his failed presidential attempt almost nine years ago. Kelly Rowland finds "Love" on dance floor

NEW YORK (Billboard) – Singer Kelly Rowland was in France last summer when she discovered DJ David Guetta, at one of his exhilarating techno shows in Cannes.

When she later met up with Guetta and asked him to play a new track for her, the French DJ unveiled a pop number built around a lush piano loop and throbbing percussion. The track, which would become the groundwork for "When Love Takes Over," moved Rowland to tears.

"I felt so much emotion from the track; something happened the first time I heard it, and it was just beautiful," Rowland says. The former Destiny's Child member took the track to London to write and record the song's vocals.

The finished product was unveiled at a show-stopping joint performance in March at Miami's Ultra Music Festival. Last month, "When Love Takes Over" was officially released as the first single from Guetta's upcoming album, "One Love," and bulleted at No. 2 on the Hot Dance Airplay chart.

Guetta and Rowland will perform the song at various points on Guetta's continent-crossing DJ tour during the summer.

A sugary, synth-laden ode to the excitement of the unknown, the single marks a sea change in style for both artists. After R&B powerhouse Destiny's Child disbanded in 2005, Rowland released her second solo album, "Ms. Kelly," on Columbia Records in 2007. The set offered accessible, uptempo R&B, but none of the tracks was as unabashedly club-oriented as "When Love Takes Over."

"I had spent nights dancing in the South of France from 12:45 a.m. to 8 in the morning," Rowland says, "but I had never thought about recording a dance track myself. Hearing David's song made me consider taking on this whole new style."

Guetta, meanwhile, is banking on the single to garner a stronger stateside following. The 41-year-old DJ has been a staple in French house music for more than a decade, but his fourth album, slated for a late August release, finds him dabbling with a techno/hip-hop hybrid he refers to as "electro-hop."

So far, splicing genres has helped raise Guetta's profile. He recently produced "I Gotta Feeling," the second single off the Black Eyed Peas' upcoming album "The E.N.D."

"The track with Kelly has made me experiment with a more American urban influence," Guetta says. "Musically, it's opened a new world for me. It's pure pop with a lot of detail, and Kelly had this Whitney Houston vibe and nailed it."

The success of "When Love Takes Over" comes at an intriguing time in Rowland's career. An amicable split with Columbia in March led the singer to explore other media, and she landed on Bravo's "The Fashion Show" as a co-host with style guru Isaac Mizrahi. The reality show premiered May 7.

Rowland also is readying a new charity called I Heart My Girlfriend, which will serve as an interactive support system for teenage girls. The program continues Rowland's long line of philanthropic work, including a bone marrow drive she spearheaded in March.

Although Rowland is still between labels and doesn't have concrete plans for another solo album, she hints that her next effort may return the favor for Guetta and focus more on the clubs. "This has definitely inspired me to put more of a dance sound on an album of my own," she says. "I want to try out that world without straying too far from my urban roots."

Facebook and Twitter hunt for revenue

Facebook and Twitter have helped make social networking a household word. Now they need to make money.

Efforts to monetize the popular Internet services are increasingly a priority within the two companies, with Facebook Chief Executive Mark Zuckerberg and Twitter Co-founder Biz Stone outlining several initiatives at the Reuters Global Technology Summit in New York this week.

And analysts and investors, in search of the next Google-like hit, are paying close attention to the breakneck speed at which Facebook and Twitter are adding new users.

While the popularity of the two social media firms has yet to translate into the kind of revenue-generating machine that Google Inc developed with its search advertising business, some say Facebook and Twitter have become so central to the Internet experience that they are inherently valuable.

"Both are new ways of communicating. And when you have a new way of communicating ... you benefit people enough so that there is going to be value there," said Tim Draper, managing director of venture capital firm Draper Fisher Jurvetson, noting that he regretted not having invested in either firm.

In April, Twitter's website attracted 17 million unique visitors in the United States, up sharply from 9.3 million the month before. Facebook grew to 200 million active users in April, less than a year after hitting 100 million users.

DIVERGENT STRATEGIES

Facebook sees advertising as its primary money-making strategy, said Zuckerberg, noting that the company could eventually offer ads not just on its own website, but on other sites that interact with Facebook.

Stone said Twitter was less interested in generating revenue through advertising than it was in offering premium features for commercial users of Twitter.

The divergent strategies underscore the novelty of social networking and the lack of an established business model.

Pacific Crest Securities analyst Steve Weinstein said advertising is probably the quickest way for social services to make money in the short term, but a purely ad-supported model does not take full advantage of the business opportunities created by social media.

"The amount of real-time information being created by Twitter is unparalleled," he said. Creating a better way to filter that information has great business potential, he said.

Because the value of social media sites improves as they become larger, Weinstein said the important thing now is for Facebook and Twitter to grow their networks and tread carefully with any monetization efforts that might inhibit that growth.

"The last thing you want to do is rush monetization and kill the golden goose," said Weinstein.

Animals can tell right from wrong

Animals possess a sense of morality that allows them to tell the difference between right and wrong, according to a controversial new book. Scientists studying animal behaviour believe they have growing evidence that species ranging from mice to primates are governed by moral codes of conduct in the same way as humans.

Until recently, humans were thought to be the only species to experience complex emotions and have a sense of morality.

But Prof Marc Bekoff, an ecologist at University of Colorado, Boulder, believes that morals are "hard-wired" into the brains of all mammals and provide the "social glue" that allow often aggressive and competitive animals to live together in groups.

He has compiled evidence from around the world that shows how different species of animals appear to have an innate sense of fairness, display empathy and help other animals that are in distress.

His conclusions will provide ammunition for animal welfare groups pushing to have animals treated more humanely, but some experts are sceptical about the extent to which animals can experience complex emotions and social responsibility.

Prof Bekoff, who presents his case in a new book Wild Justice, said: "The belief that humans have morality and animals don't is a long-standing assumption, but there is a growing amount of evidence that is showing us that this simply cannot be the case.

"Just as in humans, the moral nuances of a particular culture or group will be different from another, but they are certainly there. Moral codes are species specific, so they can be difficult to compare with each other or with humans."

Prof Bekoff believes morals developed in animals to help regulate behaviour in social groups of animals such as wolves and primates.

He claims that these rules help to control fighting within the group and encourage co-operative behaviour.

Recent neurology work has also revealed that distantly related mammals such as whales and dolphins have the same structures in their brains that are thought to be responsible for empathy in humans.

Other findings have also suggested that some animals may even be capable of showing empathy with the suffering of other species.

Prof Bekoff, who co-wrote the book with moral philosopher Jessica Pierce, also from the University of Colorado, added: "There are cases of dolphins helping humans to escape from sharks and elephants that have helped antelope escape from enclosures.

"While it is difficult to know for certain that there is cross species empathy, it is hard to argue against it."

His ideas have met with some controversy in the scientific community, but many admit it is difficult to argue that animals do not share many of the psychological qualities previously only attributed to humans.

Professor Frans de Waal, a primate behaviourist at Emory University, Atlanta, Georgia, said: "I don't believe animals are moral in the sense we humans are – with well developed and reasoned sense of right and wrong – rather that human morality incorporates a set of psychological tendencies and capacities such as empathy, reciprocity, a desire for co-operation and harmony that are older than our species.

"Human morality was not formed from scratch, but grew out of our primate psychology. Primate psychology has ancient roots, and I agree that other animals show many of the same tendencies and have an intense sociality."

WOLVES

Wolves live in tight-knit social groups that are regulated by strict rules. If a pack grows too large, members are not able to bond closely enough and the pack disintegrates. Wolves also demonstrate fairness.

During play, dominant wolves will "handicap" themselves by engaging in roll reversal with lower ranking wolves, showing submission and allowing them to bite, provided it is not too hard.

Prof Bekoff argues that without a moral code governing their actions, this kind of behaviour would not be possible. If an animal bites too hard, it will initiate a "play bow" to ask forgiveness before play resumes.

COYOTES

In other members of the dog family, play is controlled by similar rules. Among coyotes, cubs which bite too hard are ostracised by the rest of the group and often end up having to leave entirely.

"We looked at the mortality of these young animals who disperse from the group and they have four to five times higher mortality," said Bekoff.

Experiments with domestic dogs, where one animal was given a treat and another denied, have shown that they posses a sense of fairness as they shared their treats.

ELEPHANTS

Elephants are intensely sociable and emotional animals. Research by Iain Douglas Hamilton, from the department of zoology at Oxford University, suggests elephants experience compassion and has found evidence of elephants helping injured or ill members of their herd.

In one case, a Matriarch known as Eleanor fell ill and a female in the herd gently tried to help Eleanor back to her feet, staying with her before she died.

In 2003, a herd of 11 elephants rescued antelope who were being held inside an enclosure in KwaZula-Natal, South Africa.

The matriarch unfastened all of the metal latches holding the gates closed and swung the entrance open allowing the antelope to escape.

This is thought to be a rare example of animals showing empathy for members of another species – a trait previously thought to be the exclusive preserve of mankind.

DIANA MONKEYS

A laboratory experiment trained Diana monkeys to insert a token into a slot to obtain food.

A male who had grown to be adept at the task was found to be helping the oldest female who had not been able to learn how to insert the token.

On three occasion the male monkey picked up tokens she dropped and inserted them into the slot and allowed her to have the food.

As there was no benefit for the male monkey, Prof Bekoff argues that this is a clear example of an animal's actions being driven by some internal moral compass.

CHIMPANZEES

Known to be among the most cognitively advanced of the great apes and our closest cousin, it is perhaps not surprising that scientists should suggest they live by moral codes.

A chimpanzee known as Knuckles – from the Centre for Great Apes in Florida – is the only known captive chimpanzee to suffer from cerebral palsy, which leaves him physically and mentally handicapped.

Scientists have found that other chimpanzees in his group treat him differently and he is rarely subjected to intimidating displays of aggression from older males.

Chimpanzees also demonstrate a sense of justice and those who deviate from the code of conduct of a group are set upon by other members as punishment.

RODENTS

Experiments with rats have shown that they will not take food if they know their actions will cause pain to another rat. In lab tests, rats were given food which then caused a second group of rats to receive an electric shock.

The rats with the food stopped eating rather than see another rat receive a shock. Similarly, mice react more strongly to pain when they have seen another mouse in pain.

Recent research from Switzerland also showed that rats will help a rat, to which it is not related, to obtain food if they themselves have benefited from the charity of others. This reciprocity was thought to be restricted to primates.

BATS

Vampire bats need to drink blood every night but it is common for some not to find any food. Those who are successful in foraging for blood will share their meal with bats who are not successful.

They are more likely to share with bats who had previously shared with them. Prof Bekoff believes this reciprocity is a result of a sense of affiliation that binds groups of animals together.

Some studies have shown that animals experience hormonal changes that lead them to "crave" social interaction.

Biologists have also observed a female Rodrigues fruit-eating bat in Gainesville, Florida, helping another female to give birth by showing the pregnant female the correct birthing position – with head up and feed down.

WHALES

Whales have been found to have spindle cells in their brains. These very large and specialised cells were thought to be restricted to humans and other great apes and appear to play a role in empathy and understanding the feelings of others.

Humpback whales, fin whales, killer whales and sperm whales have all been found to have spindle cells in the same areas of their brains.

They also have three times as many spindle cells compared to humans and are thought to be older in evolutionary terms.

This finding has suggested that complex emotional judgements such as empathy may have evolved considerably earlier in history than previously thought and could be widespread in the animal kingdom.

Stampede At Morocco Music Concert Kills 11

Eleven people have been killed in a stampede at a stadium in Morocco where a world music festival was taking place.

It happened as thousands of spectators in the capital Rabat hurried to leave at the end of a concert wrapping up the landmark event.

About 3,000 uniformed and plain-clothed officers were at the event.

Police said the crowd surging towards one of the exits appeared to have brought down a wire fence, setting off the stampede.

Five women, four men and two children were later found dead, apparently having suffocated in the crush. At least 40 other people were injured.

The victims were among 70,000 spectators at a concert by Moroccan pop star Abdelaziz Stati at the Hay Nahda soccer stadium.

A source close to the case said all those who died were Moroccan.

Rescuers rushed to the scene to pull out survivors and transport the injured to Rabat's main hospital, Ibn Sina, where a source said all but seven of the injured had been discharged.

"Most of the injured are young," Abdelatif Benchekroun, the hospital's head of emergency care, said.

The concert was part of the week-long annual Mawazine music festival, aimed at promoting an image of tolerance and modernity in the Muslim north African kingdom.

This year's event featured Stevie Wonder, Kylie Minogue, Ennio Morricone, Khaled, Alicia Keys and Algerian diva Warda al Jazairia, and drew tens of thousands of spectators.

Mawazine, which is backed by King Mohammed, aims to liven up the capital city and ward off the growing cultural influence of powerful opposition Islamists.

Moroccan Islamist politicians have denounced pop concerts as encouraging immoral behaviour.

They argue it would be better to spend the money in creating jobs.

Computer virus strikes US Marshals, FBI affected

Law enforcement computers were struck by a Mystery computer virus Thursday, forcing the FBI and the U.S. Marshals to shut down part of their networks as a precaution.

The U.S. Marshals confirmed it disconnected from the Justice Department's computers as a protective measure after being hit by the virus; an FBI official said only that that agency was experiencing similar issues and was working on the problem.

"We too are evaluating a network issue on our external, unclassified network that's affecting several government agencies," said FBI spokesman Mike Kortan. He did not elaborate or identify the other agencies.

Marshals spokeswoman Nikki Credic said the agency's computer problem began Thursday morning. The FBI began experiencing similar problems earlier.

"At no time was data compromised," said Credic. The type of virus and its origin were not determined.

In addition to their external networks, most federal law enforcement agencies have an internal-only network to prevent cyber-snoopers from sensitive data.

In Thursday's incident, the Marshals Service shut down its Internet access and some e-mail while staff worked on the problem. The FBI made similar moves to protect its system.

Green Day lashes out at Wal-Mart policy

NEW YORK – Green Day has the most popular CD in the country, but you won't be able to find it at your local Wal-Mart.
The band says the giant superstore chain refused to stock its latest CD, "21st Century Breakdown," because Wal-Mart wanted the album edited for language and content, and they refused.
"Wal-Mart's become the biggest retail outlet in the country, but they won't carry our record because they wanted us to censor it," frontman Billie Joe Armstrong said in a recent interview.
While Wal-Mart sells CDs from acts known for raunchy content, including Eminem's latest, they offer customers the "clean" version of those CDs, which are edited for content that may be objectionable. But in Armstrong's view, "There's nothing dirty about our record."
"They want artists to censor their records in order to be carried in there," he said. "We just said no. We've never done it before. You feel like you're in 1953 or something."
"21st Century Breakdown" contains curses and some references considered adult.
Wal-Mart said that it's the company's long-standing policy not to stock any CD with a parental advisory sticker.
"As with all music, it is up to the artist or label to decide if they want to market different variations of an album to sell, including a version that would remove a PA rating," Wal-Mart spokeswoman Melissa O'Brien said. "The label and artist in this case have decided not to do so, so we unfortunately can not offer the CD."
But bassist Mike Dirnt said: "As the biggest record store in the America, they should probably have an obligation to sell people the correct art."
Not being sold at Wal-Mart didn't stop the band — which kicks off a U.S. tour summer tour in Seattle on July 3 — from landing at the top of the album charts this week. "21st Century Breakdown" sold about 215,000 copies since it's debut on Friday.
The album is the follow-up to their multiplatinum, Grammy-winning CD "American Idiot," and like that album, deals with weighty topics. While "American Idiot" spoke to the frustration over the presidency of George W. Bush and the Iraq War, this CD speaks to the loss of innocence and confusion in today's society.
While Armstrong, Dirnt and drummer Tre Cool are still top-sellers without Wal-Mart, Armstrong said the store's policy is disappointing, considering it has become the dominant seller of CDs with the decline of traditional music stores.
"If you think about bands that are struggling or smaller than Green Day ... to think that to get your record out in places like that, but they won't carry it because of the content and you have to censor yourself," he said. "I mean, what does that say to a young kid who's trying to speak his mind making a record for the first time? It's like a game that you have to play. You have to refuse to play it."

4 in 10 college kids are depressed, hopeless

WASHINGTON - Pressure about grades, student loans, relationships and school work take a toll on college students, finds a new Associated Press-mtvU poll.

More than 42 percent of those surveyed at 40 colleges said they had felt down, depressed or hopeless several days during the past two weeks, and 13 percent showed signs of being at risk for at least mild depression, based on the students' answers to a series of questions that medical practitioners use to diagnose depressive illness.

Eighty five percent of those surveyed reported feeling stressed in their daily lives in recent months, found the poll of 2,240 undergraduate students ages 18-24 at four-year colleges.

Justin Timberlake restaurant in sexual discrimination suit

An ex-manager at Justin Timberlake’s BBQ restaurant in New York has filed a suit against the company, saying she was sexually harassed while at work.

Alison McDaniel says she was forced to watch porn in a locked office at Southern Hospitality by Timberlake’s business partners, Eytan Sugarman and Ronnie Kaplan, and that they made fun of her when she broke down in tears.

The suit was filed in Manhattan Supreme Court and claims that McDaniel was fired after she complained of the harassment in writing. She did not report the alleged discrimination to the Equal Opportunity Employment Commission before filing the suit, reports the New York Daily News.
The restaurant was also sued in November by a busboy who said employees were not getting paid sufficient overtime or tips that were due to them.

When plain old Alex Ferguson arrived at Manchester United in November 1986 there were no thoughts of building a dynasty - a single league title would be an absolute godsend. United was seriously struggling, Ron Atkinson had gambled everything on the title - more or less abandoning a once flourishing youth policy to bring in experienced professionals. The season before had seen United top of the table for the first few months only to fizzle out after Christmas; with the poor form continuing into the next season when the worst league start for 40 years forced the board to act.

Ferguson was brought in to smash the pre-eminence of Liverpool and Everton in the same way that he broke up the Celtic/Rangers dominance in Scotland. But if you look at the distribution of titles up to Ferguson's appointment it is clear that his involvement at the club is more significant than seems possible. Woman kidnapped by Darryl Littlejohn offers gripping testimony at Imette St. Guillen murder trial

A sobbing young woman captivated a Brooklyn jury Monday as she recounted her daring escape from a bouncer who was later charged in the murder of grad student Imette St. Guillen.

Glancing furtively at the defense table, Shanai Woodard took the stand and fingered Darryl Littlejohn as the man who plucked her off the street and threw her into his van in October 2005.

"I said, 'What did I do? Can I call my sister?'" Woodard said, her voice trembling. "That's when he took my phone and said I can't call anyone."

She wept as she recalled Littlejohn's viciousness and the thought that she might have shared the same fate as St. Guillen, whose naked body was found dumped off the Belt Parkway four months later.

Woodard said she tried to escape by opening the door and screaming for help, but Littlejohn stopped the van and climbed into the back with her.

"He punched me in the head two to three times and he put a jacket over my head so I couldn't see," said the petite 23-year-old, glancing at an expressionless Littlejohn. "He said I was trying to be slick and trying to get away and he wouldn't let me get away."

"I said, 'Why are you doing this? What did I do? I didn't do anything.'"

St. Guillen was last seen at the SoHo bar where Littlejohn worked. The ex-con's DNA, as well as that of his brother and mother, were found near St. Guillen's body.
Littlejohn was convicted last year of abducting Woodard and has since been sentenced to 25 years to life.

St. Guillen's best friend, step-father and several others in the audience looked at Littlejohn as Woodard broke down in tears. Jurors sat up straight and listened as if spellbound.

"I managed to get the jacket off my head so I could see," she said.

She said she then decided to fling herself from the moving van. "I got the door open and pushed myself out."

"I tumbled on the ground really hard ... I landed in like a dirt patch. It happened really fast."

Littlejohn slowed the van, but apparently the sight of children playing nearby convinced him to drive off and leave the bloodied victim who might have been.

He was convicted of the Queens abduction in October and is serving 25 years to life in prison.

Normally, testimony of another crime would not be allowed. However, Justice Abraham Gerges ruled over Littlejohn's lawyers objections that similarities - a young woman abducted, hands bound behind, hit in the head and her eyes covered - were striking enough to let the jurors hear.

In fact, it was St. Guillen's case that led to the arrest of Littlejohn for the Queens abduction.

Woodard recounted that she was watching the news in February 2006 when she saw the van from the as-yet-unsolved murder of St. Guillen.

"I just started freaking out. I started crying, 'Mom, that's the van I was in," she said.

Women who smoke more prone to lung damage: study

CHICAGO (Reuters) - Women may be especially susceptible to the toxic effects of cigarette smoking, U.S. researchers said on Monday.

They said women who smoke develop lung damage earlier in life than men, and it takes less cigarette exposure to cause damage in women compared with men.

"Overall our analysis indicated that women may be more vulnerable to the effects of smoking," said Dr. Inga-Cecilie Soerheim of Brigham and Women's Hospital in Boston and the University of Bergen in Norway.

Soerheim, who presented her findings at the American Thoracic Society meeting in San Diego, California, said researchers had suspected this but until now had lacked proof.

Her team analyzed 954 people in Norway with chronic obstructive pulmonary disease, which includes lung problems from chronic bronchitis to emphysema.

COPD affects an estimated 210 million people worldwide. The most common symptoms include shortness of breath, coughing and a limited ability to exercise.

In the study, about 60 percent were men and 40 percent were women. All were current or former smokers.

Overall, both groups had similar lung impairments. But when they looked at younger people -- those under age 60 -- or those who had been lighter smokers, they found women had more severe disease and worse lung function than men.

"This means that female smokers in our study experienced reduced lung function at a lower level of smoking exposure and at an earlier age than men," Soerheim said in a statement.

Wenger: We need old heads

ARSENE WENGER has finally admitted he needs to bring older heads into his Arsenal squad.

The Gunners currently sit 18 points behind table-toppers Manchester United and face the galling prospect of seeing them seal the title in their clash this weekend.

While Wenger’s policy of giving youth a chance has continued to deliver attractive football, points have been dropped at key times in the season with critics blaming a lack of experience.

Swine Flu Not an Accident From a Lab, W.H.O. Says

The swine flu virus did not result from a laboratory accident, the World Health Organization said Thursday, working to debunk rumors started by an Australian virologist and circulated by news outlets all over the world.

“We took this very seriously,” Dr. Keiji Fukuda, the agency’s deputy director general, said of the virologist’s assertion. “But the evidence suggests that this is a naturally occurring virus, not a laboratory-derived virus.”

In a telephone news conference, Dr. Fukuda also expressed support for drug companies’ making a generic version of the antiviral drug Tamiflu. Many poor countries have no stockpiles of the drug.

Almost 6,500 confirmed cases of the new H1N1 flu have been reported from 33 countries, and 65 people have died, the W.H.O. said. About 4,300 confirmed and probable cases, with 3 deaths, were reported in the United States.

A woman in Arizona who was suffering from lung disease died last week from complications of swine flu, the Maricopa County Department of Public Health said late Thursday, Reuters reported.

The virus rumor was started by Adrian J. Gibbs, a retired plant virologist from the Australian National University, who previously published work in the journal Science questioning the idea, now accepted, that the 1918 pandemic started as a bird flu.

Dr. Gibbs, who had studied the gene sequences of the swine flu virus posted on public data banks, argued that it must have been grown in eggs, the medium used in vaccine laboratories. He reached that conclusion, he said, because the new virus was not closely related to known ones and because it had more of the amino acid lysine and more mutations than typical strains of swine flu.

His theory was reported by Bloomberg News on Tuesday. Even though scientists at the Centers for Disease Control and Prevention were skeptical and some prominent virologists openly derisive, news outlets have repeated and magnified the theory, adding speculation about bioterrorism that even Dr. Gibbs repudiated. He was also interviewed Thursday on the ABC News program “Good Morning America.”

Dr. Fukuda said a W.H.O. panel of experts had concluded that “the hypothesis does not really stand up to scrutiny.” The lysine residues and mutation rates were typical, he said, and many swine flus seem unrelated because not enough pigs are tested each year.

But he added that he doubted that the rumor would prove damaging, and he said he would not want genetic sequences kept off public databases.

“This is healthy,” he said. “This is much better than dealing with rumors where you don’t know where the mistake comes from and can’t correct it.”

Persistent false rumors, like those that AIDS is not caused by a virus or that polio vaccine sterilizes Muslim girls, have devastated efforts to control other diseases.

Scientists have yet to pinpoint the origin of the swine flu virus, the earliest cases of which were found in Veracruz, Mexico. It contains genes from flu viruses that normally circulate in pigs in Europe and Asia, as well as avian and human genes.

Late Thursday, Smithfield Foods reported that the Mexican health authorities had not found the new virus in herds at its huge hog-fattening operations in Veracruz, which some have blamed for the outbreak. But it was not clear what test was used; only blood tests for antibodies would show whether pigs had the virus in February, when the human outbreak is thought to have begun.

As for the use of oseltamivir, the generic form of Tamiflu, the W.H.O. has certified only one drug — Antiflu, made by the Indian company Cipla in both pill and liquid forms — as equivalent to brand-name Tamiflu.

Dr. Yusuf K. Hamied, Cipla’s chairman, said he would sell large amounts to Mexico and was in discussion with countries in Africa, Latin America and the Middle East.

The move could prompt patent lawsuits by Gilead Sciences and Roche, which developed and sell Tamiflu, so Cipla will sell only to countries indemnifying them against such suits, the company said.

Roche has offered 6.5 million doses of Tamiflu to the World Health Organization and 1 million doses to Mexico.

Dr. Hamied, reluctant to buy supplies for orders that might not materialize, said that poor countries should stockpile shikimic acid, the oseltamivir precursor, then pay Cipla or other generic companies to make the drug as needed.

The swine flu may cause the W.H.O. to cut short its nine-day annual conference of world health ministers so they can get home to fight the disease, Reuters reported.

Facebook members hit by another phishing scam

n what's just the latest Facebook phishing scam, hackers on Thursday broke into accounts and sent e-mails to friends urging them to log on to fake Facebook sites, according to new reports and anecdotes from members.

The social-networking site is in the process of cleaning up from the hack and is blocking compromised accounts, Reuters reported. "Victims were directed to log back in to the site, but actually logged into the one controlled by the hackers, unwittingly giving away their passwords," Reuters said, adding that the fake domains include www.151.im, www.121.im and www.123.im.

Facebook did not immediately respond to an e-mail seeking confirmation and information about the hack. The number of users affected remains unknown, but a Facebook spokesman told The New York Times it "is not widespread and is only impacting a small fraction of a percent of users."

In addition to the scam, Facebook security made the news Thursday in relation to upcoming plans for "verified apps" on the site. Under this program, Facebook will review developer apps for a $375 fee to make sure they fit security and transparency standards, and will award a graphic badge to apps that make the cut.

Obama names Dr. Thomas Frieden as director of CDC

Reporting from Washington -- President Barack Obama today named Dr. Thomas Frieden, currently commissioner of the New York City Health Department, to serve as director of the federal Centers for Disease Control and Prevention.

Dr. Rich Besser, who has served as an unusually high-profile acting CDC director throughout weeks of government response to the emergence of a new strain of flu, will stay to run the Office for Terrorism Preparedness and Emergency Response, which he has overseen for four years, the White House said today.

"America relies on a strong public health system, and the work at the Centers for Disease Control and Prevention is critical to our mission to preserve and protect the health and safety of our citizens,'' Obama said in a statement issued this morning.

Calling Frieden "an expert in preparedness and response to health emergencies,'' the president said that the New York health commissioner "has been at the forefront of the fight against heart disease, cancer and obesity, infectious diseases such as tuberculosis and AIDS, and in the establishment of electronic health records'' as well as a "leader'' care in health reform.

"His experiences confronting public health challenges in our country and abroad will be essential in this new role,'' Obama said.

Health and Human Services Secretary Kathleen Sebelius and the president also praised Besser for his handling of the H1N1 flu, which in several weeks has spread from 20 known cases inside the United States to today's CDC-reported count of 4,298 confirmed or probable cases in 46 states and the District of Columbia. Three deaths in the U.S. also have been attributed to the disease.

Frieden will start in June, the White House said.

Frieden has run one of the nation's largest public health agencies, in New York, since January 2002. The White House credits him with leading efforts to reduce smoking, increase cancer screening and combat AIDS.

Frieden had served at the CDC from 1990 to 2002. In the early 1990s, as an Epidemiologic Intelligence Service Officer, he investigated issues such as a spread of drug-resistant tuberculosis, according to the White House.

He holds medical and public health from Columbia University and completed infectious disease training at Yale University and has written more than 200 scientific articles.

Viruses now penetrating deeper

New malware variants have taken researchers by surprise by adapting new "stealth" methods to penetrate systems deeper so as to avoid detection, according to Kaspersky Lab.

The antivirus company said in a video conference Wednesday, a new variant of botnet, Sinowal--also known as Torpig--marks the first time cybercriminals have used such sophisticated methods.

Kaspersky said Sinowal writes itself to the user's hard drive master boot record (MBR), the operating system's lowest level, and has been successful in avoiding detection by antivirus products.

It said the worm has has over the last month been actively spreading through a number of methods including Web sites exploiting the Neosploit rootkit and a vulnerability in PDF software, Adobe Acrobat Reader.

Konstantin Sapronov, head, virus lab, China, Kaspersky, said new methods of infiltration have also rendered it nearly impossible for users to avoid infection, even if they are careful. Seemingly clean sites can also perform backend redirection to malware-ridden sites.

Sapronov said Web malware authors have favored redirection exploits on Web apps and search fields, like iFrame attacks during 2008, compared to 2007 which saw more Trojan horses and droppers being used.

The Web has also overtaken e-mail as the top transport medium for viruses, with the number of infected sites growing 300 percent in 2008, he said.

Swine flu infects the net

HEALTH WEBSITES have had a bad case of swine flu fever over recent weeks as hypochondriacs walloped the sites to learn if their sniffles were something a bit more serious.

According to the AP, Internet traffic to the website of the US Centers for Disease Control and Prevention soared in April as Americans searched for information about swine flu.

Comscore said the number of unique US visitors to CDC.gov rose by 142 per cent in April compared with the previous month to 5.7 million.

Jack Flanagan, executive vice president of Comscore Media Metrix said that when news of the swine flu pandemic erupted, many Americans turned to the Internet as their primary source of information for how to keep themselves and their families safe.

As a result many of them may now think they are suffering from either swine flu or the bubonic plague when all they really have is a slight case of the spring sniffles.

Microsoft, China's Hangzhou set 'model city' pact

SHANGHAI -

Microsoft Corp. announced a partnership aimed at helping make the eastern Chinese city of Hangzhou a model for innovation and protection of intellectual property, in the company's latest attempt to combat rampant software piracy.

A three-year agreement signed Friday calls for setting up two new centers in Hangzhou to focus on developing the local technology industry. Microsoft will provide curriculum support, technology and training for teachers at Hangzhou Normal University through an institute set up to nurture local innovation.

"Partnering with leading IT companies like Microsoft will greatly boost Hangzhou's innovative capabilities and help us build a model information technology city in China," Cai Qi, Hangzhou's mayor, said in a statement.

No dollar figure was announced for the plan. Spending will be above the roughly $1 billion the company pledged in November to spend on research and development in China over the following three years.

The deal came after Hangzhou pledged to improve its enforcement of anti-piracy laws and promote the use of legitimate, non-pirated software by individuals, government offices and companies based in the city, which is west of Shanghai.

Software, movie and music makers, among many industries, say they lose billions of dollars each year to counterfeited and pirated products.

The deal calls for the two sides to set up a working team from both sides that will hold regular meetings to assess progress in that area, Alec Cooper, general manager of Microsoft Greater China's "Genuine Software Initiative," told reporters in a conference call.

"There is some degree of piracy in virtually every country around the world. We said, here's what we think are the best practices and here's what we think will work in China, and make it a more positive approach," Cooper said.

He said the partnership will focus on educating local people and businesses on the importance of fighting piracy of software and other intellectual property to their own economic future.

"We think it's an approach that addresses the root of the problem," he said.

Raising consumer awareness was the motivation behind Microsoft's Windows Genuine Advantage program, which turns the wallpaper of computers using pirated Windows software black and notifies users, urging them to get a legitimate copy.

That effort continues, Cooper said, despite complaints from some Chinese computer users.

Software piracy is still rampant despite individual countries' attempts at cracking down. Research commissioned by the Business Software Alliance, an industry trade group, found that 82 percent of the software used in China in 2007 was not legitimately purchased, more than double the worldwide piracy rate of 38 percent.

But Hangzhou, one of China's wealthiest cities, is seeking to build up its technology industries as it shifts away from textile making and other traditional manufacturing.

"They understand that to get the best companies in the world to be located in Hangzhou ... companies need to feel comfortable about their intellectual property," Cooper said, adding that Microsoft may seek such arrangements with other cities in the future.

An ex-con was charged Thursday with the fatal-attraction stabbing of a Bronx woman he wooed on the Internet and ambushed on a park bench - after the dying victim whispered his name to cops, police said.

Nimzay Aponte, 23, was close to death at Lincoln Hospital when she told cops at her bedside, "Mike did it," police said.

"Mike" was the screen name used by violent Bronx felon Raymond Dennis, 35, on the Internet dating site Local-Hookupz.com, cops said.

Investigators believe Dennis flew into a rage when Aponte refused to meet him in person after the pair chatted online through Local Hookupz and AOL Instant Messenger.

A convicted drug dealer with more than a dozen arrests, Dennis allegedly tracked Aponte to a job fair she was attending in the Bronx on Monday.

He found her outside the job fair, chatting with a group of men and women.

"Isn't this lovely?" Dennis fumed at Aponte, according to police sources. "What's this? Some kind of double date?"

Dennis stormed off, but the following day, he returned to the facility inside St.Mary's Park with a knife, cops said.

He spotted his Internet crush chatting with another guy on a park bench.

Enraged, he crept up behind the pair and stabbed the man in the leg before plunging his knife into Aponte's lower back and side, police said.

"I told you not to lie!" Dennis screamed before fleeing, sources said.

Aponte was fatally wounded. Her 25-year-old pal survived.

Armed with Dennis' screen name, cops tracked him down at the corner of Webster and Tremont Aves. Thursday. He was charged with murder, criminal possession of a weapon and assault.

Aponte's longtime friend and roommate, Carbet Tapia, 24, said Aponte told her Dennis was "a crackhead" and a stalker who had threatened her the day before she was stabbed.

Tragically, Aponte considered him harmless and just "an annoyance."

"The day before she was murdered, this guy confronted Nimzay and the guy in the same park where she was killed," Tapia said. "He said he didn't want to see her with another guy."

It wasn't the first time Dennis had allegedly attacked a woman.

Last October, he was busted for punching a woman in the face so hard she spit blood, police said. He pleaded guilty and was sentenced to four months behind bars.

In 2007, he threatened ex-wife Rashida Dunne, who had an order of protection against him. "I'm going to take you off this Earth," he told her in a phone call.

He pleaded guilty to harassment and was sentenced to a conditional discharge.
